Intoxicating Hemp-Derived Products: Delta-8, HHC and Related Compounds in Law
How United States law, courts and the United Nations treat delta-8 THC, delta-10 THC, THC-O and HHC, what the 2025 hemp change would do, and what we could not verify.

Laws change; this is not legal advice
"Hemp-derived" describes where a product started, not whether it is lawful or safe. This page summarizes what government and Congressional Research Service (CRS) sources said when we read them on 2026-10-22. Legal status is in motion, so treat this as a map of the questions, not a current answer for any product or place. Compound identities are on delta-8 THC, HHC and cannabinoid acetates (THC-O).How the question arose
The 2018 Farm Bill defined hemp by delta-9 THC alone. CRS says that left products with other psychoactive cannabinoids arguably outside federal drug control, including delta-8 THC, delta-10 THC and THC acetate ester (THC-O), which some viewed as a loophole. [1]The FDA describes delta-8 THC as one of over 100 cannabinoids made by the plant but not found in significant amounts, so concentrated amounts are typically manufactured from hemp-derived CBD. [2] It says delta-8 products have not been evaluated or approved for safe use in any context. [2]
Federal agencies and courts, as read
- DEA position. CRS says the DEA read the "THC in hemp" exception as covering only chemicals that occur naturally in the plant. Delta-8 and delta-10 occur in small amounts and can also be synthesized; THC-O does not occur naturally, so the DEA took the position that THC-O stayed controlled. [1]
- Courts disagreed with parts of that. One federal appeals court held THC-O fell within the 2018 hemp definition, and another had held delta-8 THC did. [1]
- Justice Department, April 2026. A final rule says tetrahydrocannabinols that can be derived only through artificial synthesis (for example delta-10-THC) are outside the definition of marijuana, and that synthetic THC remains in Schedule I. [3]
What the 2025 hemp change would do
Public Law 119-37 changes the hemp definition to total THC, scheduled for November 12, 2026. CRS says it would also exclude hemp-derived cannabinoid products containing cannabinoids that are not capable of being naturally produced by the plant, or that were synthesized or manufactured outside the plant. [4] Products excluded would be regulated as marijuana under the Controlled Substances Act. [4] The law directs FDA to publish lists of cannabinoids, which CRS says had not appeared as of August 2026, and the effective date was under debate. [4] Whether a specific compound falls inside or outside the exclusions is not something we could confirm, because the FDA lists are the deciding material.States
CRS reports that, as products above 0.3% total THC have entered the market, many states have passed or are debating laws restricting or prohibiting them. [5] Industry challenges have been filed, and CRS says the Fourth and Eighth Circuit Courts of Appeals upheld such laws from Virginia and Arkansas. [5] We did not read a current state-by-state list, so we state no rule for any other state. Check your state's regulator.International: HHC
UNODC reports that the Commission on Narcotic Drugs added hexahydrocannabinol (HHC) to Schedule II of the 1971 Convention on Psychotropic Substances, effective 6 December 2025, and calls it the first semi-synthetic cannabinoid placed under international control. [6] Countries then decide how to put this into national law; we did not verify any country's rule, including the United States.Safety signals
The FDA received 104 adverse event reports on delta-8 products from December 2020 to February 2022, including hallucinations, vomiting, anxiety and loss of consciousness, and poison control centers received 2,362 exposure cases in a similar period. [2] See HHC identity and safety questions and when to seek urgent help. In the United States, Poison Help is 1-800-222-1222 and emergencies are 911.Frequently asked questions
Is delta-8 THC legal?
No single answer is accurate. Federal agencies, courts and states have disagreed, and several states restrict it. Under the amended federal hemp definition, products made by converting other cannabinoids outside the plant would be excluded from hemp. [5][4]
Is HHC legal?
HHC was added to Schedule II of a 1971 UN Convention in 2025, effective December 6, 2025. Its status in any particular country depends on national law, which we did not verify. [6]
Does "hemp-derived" mean legal?
No. The FDA warns the word may mislead people into thinking a product is non-psychoactive. [2]
Who decides whether a compound is "naturally produced"?
Under the 2025 law, FDA lists are meant to help; CRS says they had not been published as of August 2026. [4]
