Delta-8 THC: What It Is, How It Is Made and Regulatory Warnings

What delta-8 THC is, why it is rarely found in meaningful amounts in the plant, what regulators and poison centers have reported, and what is still unknown.

Urgent: children and pets

Delta-8 products are often made as gummies, chocolates and candies. The FDA says they should be kept out of the reach of children and pets. [1] In the US, call 911 for an emergency, or Poison Help at 1-800-222-1222; see Poison Help by country and accidental child and pet exposure.

Overview and classification

Delta-8 THC (also written delta-8-tetrahydrocannabinol or Δ8-THC) is a psychoactive cannabinoid. It is a close chemical relative of delta-9 THC, the compound usually meant when people say "THC". The two differ in where one chemical bond sits in the molecule, which is why they are called isomers. The FDA describes delta-8 THC as having psychoactive and intoxicating effects similar to delta-9 THC. [1] For the main compound, see THC. This guide uses plain evidence labels: approved medicine, mixed, insufficient evidence, preclinical (cells/animals only), evidence of harm and marketing claim. "Proper evidence not found" means we looked and found nothing usable.

Where it comes from

Delta-8 THC is one of over 100 cannabinoids made naturally by the plant, but the FDA says it is not found in significant amounts there. [1] A 2024 chemistry review notes it was first isolated in 1966 from cannabis in very low yield, and that the marketed products contain delta-8 THC from synthetic sources. [2] The FDA says concentrated delta-8 THC is typically manufactured from hemp-derived CBD. [1] In other words, a product that is mostly delta-8 THC is a converted product, not a plant extract in its natural proportions. This page does not describe how conversion is done. For the broader categories, see natural, semisynthetic and synthetic cannabinoids.

What research shows

  • Pharmacology. A 2022 review found the way the body absorbs and responds to delta-8 THC and delta-9 THC to be very similar, with lower potency for delta-8 in clinical studies, explained by weaker binding to the CB1 receptor. [3] The review draws on studies going back decades. Label: mixed.
  • Gaps. The same review says more studies are needed, particularly in humans. [3] A 2023 scoping review of 103 documents found that most research used animal or cell models or focused on identifying the chemical in products. [4]
  • Medical benefit. Proper evidence not found. We looked for human trials showing a treatment benefit of consumer delta-8 products and found none in the sources read. The FDA says these products have not been evaluated or approved for safe use in any context. [1]

Risks and adverse effects

  • FDA adverse event reports. The FDA received 104 reports between December 1, 2020 and February 28, 2022. [1] Of these, 55% required intervention (for example emergency medical services) or hospital admission. [1] These are voluntary reports, not rates of harm.
  • Poison centers. Among 2,362 US poison center cases in the FDA's summary, 41% involved people under 18. [1] A later study of 2021 to 2022 poison center data counted 5,022 cases for delta-8, delta-10 and THC-O acetate, 98.1% of them delta-8; children under 6 made up 30.1%, and 38.4% had a serious medical outcome. [5] The authors note the system is passive and limited. [5] Label: evidence of harm signals.
  • Case reports. Three adults were hospitalized with psychotic symptoms after regular delta-8 use only. [6] One man developed visual snow syndrome after eating less than half of a delta-8 gummy. [7] Case reports show a possible link, not proof of cause.
  • Large amounts. NIDA says eating large amounts of delta-8 products has led to medical emergencies, including breathing problems. [8]

Quality and labeling concerns

The FDA lists concerns including variable formulations and labels, other cannabinoid and terpene content, and variable delta-8 concentrations. [1] Some products are labeled simply as "hemp products", which may mislead people who think hemp means non-psychoactive. [1] The FDA also warns that some manufacturers may use unsafe household chemicals in conversion and that by-products may remain. [1] A 2023 review found no regulations on synthesis, and products that were contaminated or gave inconsistent effects. [4] A certificate of analysis shows what a lab found in one batch; it does not make a product safe.

Legal status: not a simple answer

This is not legal advice; laws change. The following was read on 2026-10-22.
  • United States, federal, synthetic THC. In its 2020 interim final rule the US Drug Enforcement Administration said the 2018 Farm Bill does not change the control status of synthetically derived tetrahydrocannabinols, and that all of them remain Schedule I. [9] We did not read court decisions or other agency documents, so we do not say how this applies to any particular product.
  • United States, hemp definition. According to the Congressional Research Service, a November 2025 law (P.L. 119-37) changed the federal hemp definition to a total THC limit and excludes products with cannabinoids that are not made naturally by the plant, or that were made naturally but synthesized or manufactured outside it. [10] The new definition takes effect November 12, 2026, and the CRS says it is unclear how federal enforcement will work. [10]

Special groups and drug tests

Children, pregnant or breastfeeding people, and anyone with a psychotic or mood disorder or on regular medicines should speak with a clinician before any THC-type product. Proper evidence not found for delta-8-specific safety in these groups in the sources read; see pregnancy and breastfeeding. A 2023 study found some common urine screening tests may detect related analogs. [11]

Frequently asked questions

Is delta-8 THC the same as delta-9 THC?

They are isomers with very similar behavior in the body in the studies reviewed, but delta-8 has shown lower potency in clinical studies. [3]

Is delta-8 THC natural?

The plant makes it only in very small amounts. [1] Marketed products contain delta-8 THC from synthetic sources. [2]

Is delta-8 THC safe?

The FDA says delta-8 THC products have not been evaluated or approved for safe use in any context, and it has received adverse event reports. [1]

Is delta-8 THC legal?

It depends on the place and the product. US federal rules were being changed by a 2025 law that takes effect November 12, 2026. [10] This is not legal advice.

Can delta-8 show up on a drug test?

A 2023 laboratory study found six common urine screening kits may detect related analogs. [11] See cannabis and drug testing.
